2009 GMC Canyon Truck Raffle Rules
ELIGIBILITY You must be 18 years or older to purchase a raffle entry. Only one (1) individual may be identified as the purchaser (or buyer) of the raffle entry. All federal, state and local laws and regulations apply. Tickets can be sold at First Mountain Bank in Lucerne Valley, CA, by agents, volunteers or ticket sales events as scheduled. Raffle tickets are non-transferable and non-refundable; all tickets sales are final.
The Mitsubishi Cement Corporation Educational Foundation Board and committee members, and the Don Ferrarese Foundation Board and committee members, Mitsubishi Cement Corporation personnel, Lucerne Valley Union School District personnel, First Mountain Bank personnel as well as all of their families, and volunteers, can purchase tickets and have a chance to win.
Entries without proper payment received will be deemed invalid and shall be immediately disqualified.
DRAWINGS As many entries as possible will be sold for this raffle. Ticket prices are one (1) ticket for $5.00. The Grand Prize Draw Date is Saturday, October 17, 2009, 3:00 p.m. (PST). Drawing will be held at the Ride in the Rocks fundraising event at the Lucerne Valley Middle/High School, 33233 Rabbit Springs Road, Lucerne Valley, California. Tickets can be purchased until 2:45 p.m. (PST) October 17, 2009.
GRAND PRIZE Greiner Pontiac-Buick inc. will accept the Grand Prize vehicle, a 2009 GMC Canyon, on trade for cash or as collateral towards the purchase of a different model should the winner prefer a different vehicle or cash instead of the grand prize.
NOTIFICATION OF WINNERS Winner need not be present to win. Winner will be notified in writing via Certified Mail of requisite procedure to claim prize. Winner's name will be posted at (RideintheRocks.com) within 15 calendar days of the drawing. Winning entrant is required to inform Mitsubishi Cement Corporation Educational Foundation office within (14) calendar days from notification of their choice to take possession of the Dream Truck or accept cash, however, winners may have up to forty five (45) calendar days of draw date to finalize the process (including payment of taxes, withholding, etc). Winning entrants' name and location by city or town and photo will be printed in select media.
If selected winning entrant is unable to be contacted or located after a period of six (6) months from the draw date, the prize will be donated to the Mitsubishi Cement Corporation and the Don Ferrarese Foundation. Three (3) attempts will be made to contact the winning entrant via certified Mail at the address provided by the entry purchaser.
TAXES AND IRS RULES Winner is responsible for any and all federal, state and local income or excise taxes, fees, assessments and like charges associated with the prizes. Vehicle winner will be responsible for any and all state or local tax, license, title and registration fees associated with taking delivery of the vehicle. Winner will be responsible for any or all delivery fees and/or are responsible for retrieval of their prize.
Winner will be required to pay a withholding percentage (29%) of the fair market value of the vehicle prior to taking possession of the prize, to comply with IRS for Federal and State withholding requirements. If winner opts to trade for cash or alternate vehicle, payment to winner will be paid net of applicable taxes. This is to comply with the IRS ruling that requires that tax withholding on prizes of $5000 or greater must be paid upon award and distribution by the organization hosting the raffle. The value of your winnings is considered taxable income. Please consult your financial advisor to discuss any impact on your personal taxable income.
The IRS has taken the position that amounts paid for chances to participate in lotteries, raffles, or similar programs are not gifts and therefore, the price of entry does not qualify as a deductible charitable contribution. Government rules regarding withholding can change without notice. Mitsubishi Cement Corporation / Don Ferrarese Foundation raffle committee will follow IRS rules in effect at the time the prizes are awarded.
WAIVER/LIMITATIONS OF LIABILITY Entrants, by participating (and winner accepting a prize) release the Mitsubishi Cement Corporation Educational Foundation, the Don Ferrarese Foundation, Greiner Pontiac-Buick, Inc., agents, employees, volunteers, including advertising and promotion agencies, from any and all liability with respect to participation in the promotion and possession or use of the prize(s) awarded. Entrants will not hold Mitsubishi Cement Corporation Educational Foundation, Don Ferrarese Foundation, responsible or liable for any or all accidents, theft or damages resulting by their participation in this event.
RELEASE Entrants, by participating, agree to allow Mitsubishi Cement Corporation Educational Foundation, Don Ferrarese Foundation to use their names, photos and statements in promotional material. The Mitsubishi Cement Corporation Educational Foundation, Don Ferrarese Foundation will not share other personal information from entries with other organizations.
